Insufficient Insurance Coverage
Whether you have proper insurance coverage is something you need to consider as both a home and car owner.
As a homeowner, the never ending increase in property values ought to be considered when negotiating for coverage on a new or existing home. Increases in value associated with a new or newly renovated property or simply due to the rising cost of living can lead to negligence where an agent or broker fails to institute proper coverage.
As a car owner, your insurance agent or broker owes a duty of care to make sure that the policy you purchase properly protects you after an accident. A proper car insurance policy covers you and your family regardless of who is at fault.
If you or your loved one are at fault for the accident it is important to have a policy with limits that are sufficient to protect the assets of anyone who can be found responsible. Having $1,000,000 in limits available to protect you is often not enough if you have a home (or other assets) that are worth more than the coverage purchased. Many people do not know that they are personally responsible for damages beyond the amount of insurance available.
If you or your loved one have been hurt in an accident it is important to have sufficient coverage to pay for the income, medical, rehabilitative and/or other forms of assistance you may need after an accident. A basic policy provides only minimal protection that may not protect you if you are earning even an average living or if you suffer significant injuries or impairments.
Improper Coverage Exclusions
Improper coverage exclusions are becoming more common in an era of ride sharing services. Policies for vehicles that are being used for commercial purposes are the ones where negligence is more often found. Most vehicles are insured for personal use only. It is the responsibility of your agent or broker to ask questions to determine if a commercial policy is appropriate. This responsibility is shared by the person purchasing the policy who ought to disclose if the vehicle is intended to serve a commercial purpose.
Optional Benefits
Recent and anticipated changes to the laws surrounding insurance typically reduce, and in some cases eliminate, coverages that were previously available or purchased. This is particularly the case in car insurance policies where protections that were previously provided may not still be in place when a new policy is purchased.
The most recent round of significant changes to car insurance policies became effective on June 1, 2016. As an example, a person who purchased their policy on May 31, 2016 could have available $1,000,000 in both the need for an attendant and for their medical or rehabilitative needs. A person who purchased their policy on or after June 1, 2016 may have only $1,000,000 combined under both headings.
An insurance agent or broker owes a duty to inquire what level of coverage provides proper protection. For example, a person earning an income of more than $60,000/year will lose over half of their recoverable earnings if their policy provides the typical maximum income replacement benefit of $400/week. It is the responsibility of your insurance agent or broker to determine what benefits should be available and to explain that optional benefits can be purchased usually for only a few dollars a month more.
